Regulations for the TecLine Regulators’ Registration and accounts management in the TecLine Support System

I. Definitions

 §1

In the following statute – TecLine Support, hereafter called „Statute”, the following terms shall be defined:

a) Regulator – one or multiple pressure regulators or scuba regulators used in scuba diving, figuring on the list defined by the Manufacturer within the Account.

b) Manufacturer – Scubatech spółka z ograniczoną odpowiedzialnością with headquarters in Mierzyn, Poland (72-006), Lubieszyńska 2, registered in National Court Register managed by the Regional Court-Centrum in Szczecin, Poland – XIII Comercial Division KRS nr KRS 0000127550, with the equity of 50.000 PLN, paid off in total, REGON: 812518984, NIP/VAT: PL8522364001, e-mail: scubatech@scubatech.pl,,

c) Client – any person who agreed with the Seller on a contract of an Account creation,

d) Account – an account created by a Client on the website: https://support.teclinediving.eu/   according to the rules described in the Regulations,

e) Consumer – a person defined in the legal regulation art. 221 of the Civil Code, the moral person transaction with an entrepreneur not directly related to its business or professional activity.

II.General provisions

 §2

The Statute defines the rules of the electronically supplied services provided by the Manufacturer to Clients, enabling them to create Accounts entitling to the extended warranty period (10 years from the first purchase date), and the possibility to communicate online with manufacturer in regards of the Regulators and their functioning.

 §3

The content presented on the website and subpages www.teclinediving.eu, in particular announcements, advertisements, price lists and other information, are not a commercial offer within the meaning of art. 66 and 661 of the Civil Code, but an invitation to submit offers.

§4

  1. Making use of an extended, 10-years warranty for a Regulator requires prior registering and an Account creation. The registration procedure is described in the part III of the Statute
  2. The extended 10-year warranty period is counted from the date of the first purchase of the Regulator indicated in the warranty card of the Regulator and confirmed by the Seller. The manufacturer has the right to verify the correct date of purchase indicated in the warranty card and provided at the Account registration.
  3. Creating an Account is unambiguous with the acceptance of the Statute, which is confirmed by an appropriate statement made when completing the registration form by a person wishing to set up an Account.

§5

The Account can be created by any Regulator’s buyer around the World.

§6

To use the Account, it is not necessary to meet any specific, technical requirements in regards of a computer or any other device of the Client. However, certain requirements must be met to create and operate the Account: access to the Internet, possession of an e-mail address and a standard operating system and Internet browser not older than IE 10.

III. Account

 §7

An Account can be set up by the purchasers of the Regulators who retain a status of: moral persons with full legal capacity (and therefore adults who are non-incapacitated or persons who have reached the age of majority as a consequence of marriage), legal bodies or organizational entities without legal personality, granted the legal capacity by the law.

 §8

  1. A person willing to establish a contract of electronically supplied services (creating and managing an Account) with the Manufacturer, should click the Support tab located at the top of each of the sub-pages included in the https://www.teclinediving.eu website. The register form included in the https://support.teclinediving.eu website is the Manufacturer’s offer addressed to the Customer regarding the conclusion of the contract of an Account creation.
  2. The Regulator’s registration form should be completed with: e-mail address, Account password, name,. The customer may also provide a contact telephone number.
  3. After creating an Account the Customer may at all-time register the Regulator adding  date of purchase of the Regulator indicated on the warranty card confirmed and provided by the Seller of the Regulator and serial number of the Regulator.
  4. It is forbidden to add unlawful content in the form.
  5. To send the form and complete the registration procedure in the Store, it is necessary to accept the Statute, Privacy Policy and accept the processing of personal data for purposes related to the proper provision of services covered by the Statute. The consent for the personal data processing for marketing purposes and for sending commercial information is voluntary and is not necessary for the creation of an Account.
  6. Clicking the “Register” button sends the registration form and is tantamount to acceptance of the Manufacturer’s offer. In this moment, the contract of setting up an Account is established between the Manufacturer and the person who filled out the registration form.
  7. After the conclusion of the contract, in accordance with the provisions of the above paragraph, the Manufacturer sends a message confirming the creation of the Account to the e-mail address provided by the Client. The Statute and privacy policy are attached in the e-mail.

 §9

The Client should carefully store his/her Account login data, so that no unauthorized person has access to this data.

 §10

The remaining warranty period for the registered Regulators can be tracked after logging into the Account.

 §11

After logging in to the Account, the Client has an option of updating his/her data entered when setting up the Account.

IV. Duration of the contract of setting up an Account

 §12

The contract of setting up an Account is established for an indefinite period of time.

 §13

  1. The Client may terminate the contract at any time by sending a notice to the address provided in § 1 letter a, by e-mail to the address scubatech@scubatech.pl  or in another form. The contract will be terminated upon receipt of the notice by the Seller. The Client’s Account will be deleted within 3 days from the date of receipt of the notice.
  2. The Seller may terminate the contract of setting up an Account only in the following cases:
    a) Termination of the service of the extended warranty period,
    b) Entering an unlawful information in the registration form by the Client.

In such cases the contract of setting up an Account in the Store will be terminated within a one-wee notice period.

V. Final provisions

 §14

All headings used in the content of the Statute are intended only to facilitate the orientation in the text.

Regulamin rejestracji Automatów i prowadzenia Konta

I. Definicje

§1

W niniejszym regulaminie TecLine Support, zwanym dalej „Regulaminem”, pod poniższymi pojęciami należy rozumieć:

a) Automat – jeden lub klika z produkowanych przez Producenta regulatorów ciśnienia lub automatów oddechowych służących do nurkowania wskazanych na liście zdefiniowanej przez Producenta w ramach Konta,

b) Producent – Scubatech spółka z ograniczoną odpowiedzialnością z siedzibą w Mierzynie (72-006), przy ul. Lubieszyńska 2, zarejestrowaną w Krajowym Rejestrze Sądowym prowadzonym przez Sąd Rejonowy Szczecin-Centrum w Szczecinie, XIII Wydział Gospodarczy Krajowego Rejestru Sądowego pod nr KRS 0000127550, o kapitale zakładowym w wysokości 50.000 złotych, opłaconym w całości, REGON: 812518984, NIP: 8522364001,

c) Klient – każda osoba, która zawarła ze Sprzedawcą umowę o założenie konta w Sklepie,

d) Konto – konto Klienta założone przez niego na stronie https://support.teclinediving.eu/  zgodnie z zasadami określonymi w Regulaminie,

e) Konsument – osoba zdefiniowana w przepisie art. 221 Kodeksu cywilnego, czyli osoba fizyczna dokonująca z przedsiębiorcą czynności prawnej niezwiązanej bezpośrednio z jej działalnością gospodarczą lub zawodową.

II. Postanowienia ogólne

 §2

Regulamin określa zasady świadczenia usług drogą elektroniczną przez Producenta na rzecz Klientów polegających na umożliwieniu im bezpłatnie stworzenia Konta uprawniającego do korzystania z wydłużonego, 10 letniego od daty pierwszego zakupu, okresu gwarancji na Automat oraz możliwości komunikowania się  przez Internet z producentem w sprawie Automatu.

§3

Treści prezentowane na stronie oraz podstronach www.teclinediving.eu, a w szczególności ogłoszenia, reklamy, cenniki i inne informacje, nie są ofertą handlową w rozumieniu przepisów art. 66 i 661 Kodeksu cywilnego, lecz zaproszeniem do składania ofert.

§4

  1. Skorzystanie z wydłużonej, 10 letniej gwarancji na Automat wymaga uprzedniej rejestracji i założenia Konta. Procedura rejestracji została opisana w postanowieniach części III. Regulaminu.
  2. Wydłużony okres 10 letniej gwarancji liczony jest od daty pierwszego zakupu Automatu wskazanej w karcie gwarancyjnej Automatu i potwierdzonej przez sprzedawcę. Producent ma prawo dokonać weryfikacji prawidłowości daty zakupu wskazanej w karcie gwarancyjnej oraz podanej przy rejestracji konta.
  3. Założenie Konta jest równoznaczne z akceptacją Regulaminu, co jest potwierdzane stosownym oświadczeniem składanym przy wypełnianiu formularza rejestracyjnego przez osobę chcącą założyć Konto.

§5

Konto założyć może każdy nabywca nowego Automatu na całym świecie.

§6

Do korzystania z Konta nie jest konieczne spełnienie szczególnych warunków technicznych przez komputer lub inne urządzenie Klienta. Wystarczający jest: dostęp do Internetu, posiadanie adresu e-mail oraz standardowy system operacyjny i przeglądarka internetowa nie starsza niż IE 10.

III. Konto

§7

Konto mogą założyć:  osoby fizyczne posiadające pełną zdolność do czynności prawnych (a zatem osoby pełnoletnie nieubezwłasnowolnione lub osoby, które uzyskały pełnoletniość poprzez zawarcie małżeństwa), osoby prawne lub jednostki organizacyjne nieposiadające osobowości prawnej, którym ustawa przyznaje zdolność prawną, które są nabywcą Automatu.

§8

  1. Osoba chcąca zawrzeć z Producentem umowę o założenie Konta powinna kliknąć zakładkę Support znajdującą się w górnej części każdej ze stron www składających się na stronę teclinediving.eu. Znajdujący się tam stanowi ofertę Producenta skierowaną do Klienta w przedmiocie zawarcia umowy o założenie Konta.
  2. Następnie należy wypełnić powyższy formularz i podać w nim: adres e-mail, hasło do Konta, imię, .
  3. Zabronione jest dodawanie w formularzu treści o charakterze bezprawnym.
  4. Do wysłania formularza i zakończenia procedury rejestracyjnej w Sklepie niezbędna jest akceptacja Regulaminu, polityki prywatności oraz wyrażenie zgody na przetwarzanie danych osobowych w celach związanych z prawidłowym świadczeniem usług objętych Regulaminem. Wyrażenie zgody na przetwarzanie danych osobowych w celach marketingowych oraz na przesyłanie informacji handlowej jest dobrowolne i nie jest konieczne dla zawarcia umowy o założenie Konta.
  5. Kliknięcie przycisku powoduje wysłanie formularza rejestracyjnego i jest równoznaczne z przyjęciem oferty Producenta. Z tą chwilą między Producentem, a osobą, która wypełniła formularz rejestracyjny dochodzi do zawarcia umowy o założenie Konta.
  6. Producent po zawarciu umowy, zgodnie z postanowieniem ustępu powyższego, wysyła do Klienta, na podany przez niego adres e-mail, wiadomość z potwierdzeniem założenia Konta. Do wiadomości dołączany jest Regulamin oraz polityka

§9

Klient powinien starannie przechowywać swoje dane służące do logowania na Koncie, tak aby żadne osoby nieuprawnione nie uzyskały dostępu do tych danych.

§10

Pozostały okres gwarancji na Automat Klient może śledzić po zalogowaniu się do swojego Konta.

§11

Po zalogowaniu się do Konta, Klient ma także możliwość aktualizacji swoich danych podanych przy zakładaniu Konta.

IV. Czas trwania umowy o założenie Konta

§12

Umowa z Klientem o założenie Konta zostaje zawarta na czas nieokreślony.

§13

  1. Klient może w każdym czasie wypowiedzieć umowę o założenie Konta w Sklepie poprzez wysłanie wypowiedzenia na adres Sprzedawcy podany w § 1 lit a, e-mailem na adres scubatech@scubatech.pl lub w innej formie. Umowa zostanie rozwiązana z chwilą otrzymania wypowiedzenia przez Sprzedawcę. Konto Klienta zostanie usunięte w terminie 3 dni od dnia otrzymania wypowiedzenia.
  2. Sprzedawca może wypowiedzieć umowę o założenie Konta w Sklepie jedynie w następujących sytuacjach:
    1. zakończenia przez Producenta udzielania wydłużonej gwarancji lub  ,
    2. podania przez Klienta w formularzu rejestracyjnym informacji o charakterze bezprawnym.

W takim przypadku umowa o założenie Konta w Sklepie rozwiąże się z upływem tygodniowego okresu wypowiedzenia.

V. Postanowienia końcowe

§14

Wszelkie nagłówki użyte w treści Regulaminu mają na celu jedynie ułatwienie orientacji w jego tekście.
